Davao Journalist Threatens to Sue ICC Prosecutor for Cyberlibel — Says His Video Was Used Without Permission and Put His Family in Danger

A Davao-based journalist has filed a notarized affidavit demanding a public apology from ICC Senior Trial Lawyer Julian Nicholls — claiming the prosecutor used his video without authorization during Duterte's confirmation of charges hearing, and in doing so, put his family's safety at risk.

Ben Tesiorna said Nicholls showed his video during Monday's hearing — footage of Duterte watching a shooting incident via CCTV — pero presented it in a way that suggested the former president was watching the crime happen live, which Tesiorna says is a misrepresentation of the context.

'Mr. Nicholls' showing and broadcasting worldwide of any video has tainted my reputation and put me and my family in danger, as if I cooperated with him and the ICC prosecution, which I deny as well,' Tesiorna said in his affidavit dated February 26.

The ICC Office of the Prosecutor's response? Basically no comment. 'The Office is not in a position to provide further comment on matters being litigated by the Court,' their public information unit told GMA News. Neither confirming nor denying the allegations.

Tesiorna isn't bluffing — he warned that if Nicholls fails to apologize publicly, he will pursue legal action including cyberlibel, damages, and copyright infringement claims. It's a dramatic twist in an already explosive hearing: a Filipino journalist going after an ICC prosecutor. The final day of the hearing continues today with closing statements.
