Bad Week for Duterte's Lawyers: ICC Blocks Key Defense Requests Just Days Before Monday's Bombshell Hearing
Former President Rodrigo Duterte's defense team has been dealt two significant blows heading into Monday's critical confirmation of charges hearing at the ICC. Pre-Trial Chamber I unanimously denied two separate defense requests — one to compel prosecutors to reveal more information about witnesses, and another to disqualify the legal representatives of drug war victims.
On the witness issue, the defense wanted prosecutors to hand over more identifying information about certain witnesses and provide less-redacted versions of key documents, including the Document Containing the Charges. The three-judge panel — led by Presiding Judge Iulia Antoanella Motoc — shut that down, ruling that existing redactions appropriately balance public trial principles with the court's duty to protect witnesses under the Rome Statute.
The judges were blunt: "The right to a public trial does not equate to an absolute right for the public or the defense to know all details of a case if doing so would undermine the integrity of proceedings or endanger individuals." Prosecutors had argued the redactions were necessary due to sensitive security information concerning victims and witnesses.
The second rejection was equally decisive. Duterte's lawyers had tried to disqualify the external legal representatives of the drug war victims, alleging a conflict of interest. The chamber found that the defense "did not adequately demonstrate any conflict of interest or legal impediment" to warrant removing the victims' lawyers. That's two for two against Team Duterte this week.
The four-day confirmation hearing begins Monday, February 23, and runs through the 27th. Duterte himself will not attend — he waived that right, citing his rejection of ICC jurisdiction and his health. If the judges confirm the charges, the case moves to a full trial where, unlike this hearing, the accused MUST be present. The clock is ticking at The Hague.
